The law in Virginia is this:
Speeding in excess of 20 MPH over the posted limit or over 80MPH is a Class 1 misdemeanor punishable by up to a $2500 fine and/or 1 year in jail.
The punishment is up to the judge. He might give you a fine, or he can throw you in jail. It all depends on what the judge decides.
There is no provision in the law for a mandatory jail stay, although I doubt many judges would let a 90+ MPH speeding charge go without jailtime. It likely would depend on your record--if it's your first offense he might let you go with a really high fine.
Since it's a misdemeanor you have the right to a jury trial. So if Judge A. Hole wants to give you 2 days in jail for going 81 in a 65, you might want to go for a jury trail.
